Legislative Decree n. 196/2003 Art. 7 – Right of access to personal data and other rights
- The interested party has the right to obtain confirmation of the existence or the lack of personal data regarding said party, even if it is not yet recorded, as well as its communication in an intelligible form.
- The interested party has the right to obtain the information concerning: a) the origin of the personal data; B) the purpose and methods of how the data are used; C) the logic applied in the event that the data processing is carried out with the aid of electronic instruments; D) the identification of the data controller, the persons responsible and the designated representative in accordance with Article 5, paragraph 2; (E) the persons or categories of persons to whom the personal data may be disclosed or who may become aware of the data in the capacity of the appointed representative on the territory of the State of the persons responsible or assigned persons.
- The interested party has the right to obtain: A) the modification, correction or, where relevant, the integration of the data; B) the deletion, anonymisation or blocking of data processed in violation of the law, including those that are not required to be kept in relation to the purposes for which the data was collected or subsequently processed; C) the verification that the transactions referred to in points A) and B) have been made aware, including their content, of those to whom the data have been communicated or disseminated, except where such fulfilment is found to be impossible or Involves the use of means manifestly disproportionate to the protected right.
- The interested party has the right to oppose, in whole or in part: A) the processing of his/her personal data for legitimate reasons, even if relevant to the purpose of the collection; B) the processing of personal data concerning him or her for the purpose of sending advertising materials or for the direct sale or to carry out market research or commercial communication.
